1. Use of the Law Weekly Website
You are entitled to use the Law Weekly Limited ("Law Weekly") website located at www.lawweekly.com ("the Site") and access certain Law Weekly products at the Site only as a permitted user under the Subscription and/or Multi-Client Agreement(s) entered into between you or your employer or one of its affiliates and Law Weekly. In using this Site, you are also bound to comply with the terms and conditions set out below ("the Terms").
You may print and keep a copy of these Terms. They are a legal agreement between you and Law Weekly and can only be modified with Law Weekly's consent. Law Weekly reserves the right to change the Terms without your consent, as set out under Section 9 below.
2. Accuracy of Information and Disclaimer
The information and data provided on the Site (the "Data") is provided for general information only. It is not intended to address your particular requirements.
Some of the Data has been or will be obtained from third party suppliers or sources which Law Weekly believes to be reliable, but which Law Weekly cannot guarantee to be reliable. While Law Weekly shall use its reasonable endeavours to ensure that the Data is correct and is obtained from reliable sources, it does not warrant the accuracy and completeness of the Data contained on the Site.
The Data does not constitute any form of advice or recommendation by Law Weekly to you and is not intended to be relied upon by you in making (or refraining from making) any specific advisory or other decisions, and you should take your own advice and/or independently verify such information before relying on it. The Data is provided "as is" and Law Weekly accepts no liability and offers no warranties in relation to it, or the Site or its content, and expressly excludes all representations, warranties and conditions and other terms otherwise implied (including, without limitation, any implied warranties of merchantability or fitness for a particular purpose) in relation to the Data to the extent that such can be excluded by law.
If you believe any information on the Site is inaccurate, please let Law Weekly know by contacting Law Weekly at the email address set out under Section 10 of these Terms so that it may review such information.
3. Intellectual Property Rights
The Data (including any products made available to you pursuant to this Agreement (the "Products")), and all designs, text and graphics on the Site and the selection or arrangement thereof, and all software and databases forming part of the Site and/or provided by Law Weekly (together "the Material") are owned by and confidential to Law Weekly or its licensors and protected by copyright, database rights and/or other intellectual property rights throughout the world.
All copyright, database rights and other intellectual property rights in the Data and Material are and shall remain vested in Law Weekly or its licensors and except as expressly provided or granted to you by Law Weekly pursuant to this Agreement or otherwise, you will not acquire any right, title or interest in or to the Data and Material and no such rights are or shall be implied.
Where any of the Data or Material contains or has affixed to it Law Weekly's trade marks, trade names, notices or other proprietary marks, you may not alter, obscure, remove, interfere with or add to any of the said trade marks, trade names, notices or proprietary markings.
Unless expressly stated otherwise in relation to specific products, data or information displayed on the Site, you may read, print and download any [Products] for use in connection with you or your employer's business. In addition, you may use the said [Products] for other purposes, subject to first obtaining Law Weekly's prior written consent. Where you are permitted to use the [Products] for any purpose other than for use internally within you or your employer's business, you must acknowledge on such [Products] that they are owned by Law Weekly and that Law Weekly reserves all intellectual and other proprietary rights therein.
Except as expressly provided herein, you may not reproduce, modify, transmit, display, licence, create derivative works from, or sell, transfer, distribute or otherwise commercialise the Data (including the Products) or the Materials without Law Weekly's prior written consent.
Where the Material comprises software, you may not, save to the extent expressly permitted by the Indian Copyright Act, 1957, decompile, disassemble or reverse engineer any object code of such software.
All use of the Data and the Material by persons who are not otherwise authorised to use them pursuant to this Agreement, whether through unauthorised copying of the [Products] or otherwise, is strictly forbidden. You may be held responsible for any infringement of Law Weekly's intellectual property rights that arise out of or are connected with your granting any unauthorised user access to the Data or Material published on the Site.
When you link into a non-Law Weekly site from this Site, please understand it is independent from Law Weekly and that Law Weekly has no control over the content of such independent website. Whilst Law Weekly believes such sites may be of interest to you, Law Weekly does not endorse or accept any responsibility for the content or the use of such websites. Links are therefore made at your own risk and Law Weekly accepts no liability for any linked sites. You must also take your own precautions to ensure what is selected for use is free from any viruses, worms, Trojan horses or other items of a destructive nature.
You may link to our home page, but only provided you comply with the following provisions.
In linking to our home page you must do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link from any website that is not owned by you.
Our site must not be framed on any other site, nor may you modify this site, when linking to it. 5. Limitation of Liability
These Terms set out Law Weekly's entire liability to the subscriber in respect of any Data and Material provided or published on the Site.
Law Weekly accepts no liability whatsoever and, to the fullest extent permitted by law, expressly excludes all liability to any individual user for any loss or damage arising out of or in connection with browsing this Site, or use of information provided on this Site or downloading any Data from this Site including but not limited to errors, inaccuracies, omissions and misleading statements whether direct or indirect or consequential.
6. Security of and Right to Access the Site
You are solely responsible in all respects for all use of and for protecting the confidentiality of any user name and password that may be given to you or selected by you for use on the Site. You may not share these with or transfer them to any third parties (including other employees). Law Weekly shall have the right to audit your use of its user names and passwords to verify your compliance with the provisions of this agreement. You may not permit user names and passwords to be disclosed to unauthorised persons or used so as to allow unauthorised persons to gain access to the web site or any product. You may not copy or distribute any user name or password except in accordance with this agreement.
You must notify Law Weekly immediately of any unauthorised use of them or any other breach of security regarding the Site that becomes known to you.
Access to and use of this Site and the [Products] is limited to the authorised users as specified herein. If your entitlement to access this Site is the result of your employer's subscription with Law Weekly and you have no independent right to access the Site or to download or use the [Products], your licence to use the Site and the [Products] will terminate when your employment with your employer terminates or your employer terminates its subscription with Law Weekly. You and your employer shall be responsible for notifying Law Weekly of the termination of your employment, and for any unauthorised use of the Site or [Products] by you after your employment with the subscriber has discontinued.
7. Legal Jurisdiction and Dispute Resolution
Tamil Nadu law shall apply to these Terms, notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of Tamil Nadu shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms and for those purposes irrevocably submit all disputes to the jurisdiction of the Tamil Nadu courts. The place of performance shall be Chennai.
Law Weekly makes no warranty or guarantee that the Site or information available on it complies with laws other than those of India.
You acknowledge that you are bound by the terms set out herein and that the rights, restrictions and obligations (including the requirements for providing legal notice) which apply to the subscriber apply equally to you in respect of your use of the [Data/Products].
Failure by Law Weekly to enforce a right does not result in waiver of such right.
If any provision or clause in these Terms is deemed to be invalid, illegal or unenforceable, the rest of the Terms set out herein will remain in full force and effect.
Your right to use the Site and the [Data/Products] is personal to you. You may not assign or transfer your rights hereunder.
Law Weekly may amend these Terms at any time by posting such changes on this page of the Site. You should therefore review these Terms from time to time.
